Post-Dated Checks

When your account balance is low you might be tempted to beat the late fee or avoid a 5-day notice by sending your landlord a post-dated check.  If you plan to do this, here's what you need to know:

Checks are negotiable instruments whether they are undated, ante-dated or post-dated.

A check is a promise from one party to pay another party a specified amount of money. It is not illegal to write, accept, endorse or cash a post-dated check. You cannot control the check's negotiability by the date you do or do not write on it.

Both Lee Street Management and the bank may process your check regardless of it's date and without recourse.
